Selection Process: Ten minute oral argument before panel of judges at general tryouts
Each team will include two students. In each round of the competition, one student will act as a lawyer in the mediation and the other will play the role of the client. Students are judged on preparation, teamwork, how well the interests of the client are represented in the mediation process, and their ability to capitalize on opportunities during the mediation process.
Each session will be mediated by an experienced professional mediator and evaluated by a the mediator and a panel of two judges from diverse practice backgrounds.
The competition will be held over the course of four (4) days. The preliminary rounds (more than one case is mediated by teams) will be spread out over the first two days. The quarter and semi-finals will both take place on the third day. The finals will follow on the fourth and final day of the competition.
The competition consists of two segments - written and oral advocacy:
Written Advocacy - teams will provide a brief ex parte submission describing their mediation strategy.
Oral Advocacy - teams will participate in a mediation session to test their representation skills and problem-solving approach.
Pre-requisite: Alternative Dispute Resolution (Law 341 / Law 342) or Negotiations (Law 335) by the end of the Fall Term
Course Evaluation: Letter grade based upon research, written factum, performance and participation during preparation and at the competition. Enrolment in Law-473 or Law-495 satisfies the Advocacy Requirement.
