Towards a Modified Conception of the Family Lawyer
The prevailing understanding of the lawyer’s role fails to properly capture family law. Survivors of intimate partner violence (“IPV”) are particularly vulnerable to the effects of that disconnect. In this presentation, I present a recent paper, “Intimate Partner Violence and Ethical Lawyering: Not Just Special Rules for Family Law”, in which I argue that the Federation of Law Societies Model Code of Professional Conduct needs to be amended to comply with family lawyers’ legislative professional obligations and to account for IPV. In addition, I will also consider the theoretical framework explaining the lawyer’s role and interrogate its limitations for family law.
